Ex CJ Justice Torkornoo sues to be removed as Supreme Court judge

Ex Chief Justice, Justice Gertrude Torkornoo, has sued the President, John Dramani Mahama, in a bid to challenge her removal from office as a Justice of the Supreme Court.

In a judicial review case that was brought at the High Court, Justice Torkornoo argues that her removal as a Justice of the Supreme Court was illegal because the recommendation for removal was in respect of her office as the Chief Justice, and this followed a procedure entirely different from the removal of a Justice of the Supreme Court.

The former Chief Justice is therefore seeking an order of certiorari to quash the warrant of removal as a Justice of the Supreme Court by President Mahama on 1st September, 2025 on the basis that it was against the constitutional provisions for removal of the Justice of the Superior Courts, and was therefore unlawful, null and void.

She also prays for a declaration that President Mahama lacks the power to remove a Justice of the Superior Courts from office except where the removal is in accordance with Article 146 of the Constitution.
